Terms of Service, Privacy Policy, and Event Policies

These Terms of Service, Privacy Policy, and Event Policies (“Terms”) apply to the websites, event registration pages, digital content, newsletters, surveys, applications, sponsorship opportunities, in-person events, virtual events, and related services operated by DAI Events LLC, doing business as Destination AI and/or Destination AI Forum (“Destination AI,” “Company,” “we,” “us,” or “our”).

By accessing or using our website, registering for an event, purchasing a ticket, applying to participate in a program, submitting information, attending an event, or engaging with any of our services, you agree to these Terms.

Destination AI may conduct certain educational, research, community, industry, or mission-driven initiatives independently or in collaboration with affiliated entities, partners, sponsors, or other organizations. Unless otherwise stated in writing, these Terms govern your use of the website, event registration, sponsorship opportunities, paid programming, and related services operated under the Destination AI brand.

 

1. Services Covered

These Terms apply to all Destination AI services, including but not limited to:

  • Destination AI websites and digital platforms;
  • Event registration and ticketing;
  • Sponsorships, exhibitor opportunities, workshops, and roundtables;
  • Newsletters, surveys, reports, and research initiatives;
  • Start-up applications, awards, showcases, and competitions;
  • In-person and virtual events;
  • Communications, marketing, and other offerings provided by Destination AI.

We may update, modify, suspend, or discontinue any part of the Services at any time, including event programming, speakers, sponsors, pricing, features, content, or availability.

2. Information We Collect

We collect personal information and other information from you when you use our Services, including when you register for an event, purchase a ticket, subscribe to a newsletter, complete a survey, apply for a program, communicate with us, or interact with our website.

The types of information we may collect include:

  • Name, email address, phone number, mailing address, and company information;
  • Job title, employer, industry, professional background, and areas of interest;
  • Payment, billing, and transaction information;
  • Event registration details, ticket type, attendance history, and participation preferences;
  • Survey responses, application materials, speaker or sponsor submissions, and other information you voluntarily provide;
  • Website usage information, browser type, IP address, device information, pages viewed, access times, and other analytics data;
  • Information from third-party platforms, registration providers, sponsors, partners, or publicly available sources.

We may also use cookies, pixels, analytics tools, and similar technologies to understand how users interact with our website and communications.

3. How We Use Information

We may use the information we collect to:

  • Provide, operate, and improve our Services;
  • Process event registrations, ticket purchases, sponsorships, exhibitor opportunities, and applications;
  • Communicate with you about events, programming, updates, confirmations, invoices, logistics, and customer support;
  • Send newsletters, research updates, promotional materials, and information about Destination AI or selected partners;
  • Personalize your experience and recommend relevant sessions, meetings, content, sponsors, or opportunities;
  • Conduct surveys, research, benchmarking studies, and industry reports;
  • Manage event security, attendee experience, and event operations;
  • Analyze usage trends and improve our website, programming, marketing, and business;
  • Enforce our agreements, policies, and legal rights;
  • Comply with applicable laws, regulations, legal processes, and contractual obligations.

With Service Providers

We may share information with vendors, contractors, registration platforms, payment processors, email platforms, event technology providers, analytics providers, consultants, and other service providers who help us operate our business and deliver our Services.

With Sponsors and Event Partners

If you register for, attend, scan into, or otherwise participate in a sponsored session, roundtable, workshop, demo, meeting, reception, digital program, or other sponsor-supported offering, we may share relevant registration or participation information with the applicable sponsor or partner.

We may also share attendee lists or business contact information with event sponsors or partners where permitted by law and consistent with our Privacy Policy, registration disclosures, and your communication preferences.

With Your Consent

We may share your information when you direct us to do so, authorize us to make an introduction, participate in a meeting-matching opportunity, opt in to sponsor communications, or otherwise provide consent.

For Business Purposes

We may share information in connection with a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or other business transaction involving all or part of our business.

For Legal, Safety, or Compliance Reasons

We may disclose information if required by law, subpoena, court order, legal process, or government request, or if we believe disclosure is necessary to protect the rights, safety, security, or property of Destination AI, our attendees, sponsors, partners, employees, contractors, or others.

Aggregated or De-Identified Information

We may share aggregated, anonymized, or de-identified information for research, benchmarking, reporting, marketing, sponsorship, or business purposes.

5. Your Privacy Choices

You may opt out of marketing emails by following the unsubscribe instructions included in our emails. Even if you opt out of marketing communications, we may still send you non-marketing emails related to event registrations, purchases, transactions, customer service, legal notices, or other administrative matters.

Depending on your location, you may have rights to request access to, correction of, deletion of, or restrictions on the use of your personal information. You may also have the right to withdraw consent or opt out of certain sharing.

7. Third-Party Websites and Platforms

Our website and Services may link to third-party websites, platforms, sponsors, registration providers, payment processors, hotels, venues, or other external resources. We are not responsible for the content, privacy practices, security, or policies of third-party websites or platforms. Your interactions with third parties are solely between you and the applicable third party.

8. Event Registration, Tickets, and Payments

All ticket purchases, sponsorship purchases, exhibitor purchases, workshop registrations, and other paid opportunities are subject to the pricing, policies, deadlines, and terms stated at the time of purchase or in a separate written agreement.

You agree to provide accurate and complete registration and billing information. You are responsible for all charges, fees, and applicable taxes associated with your purchase.

Destination AI may use third-party platforms to process registration, ticketing, and payments. We do not control the policies or practices of those third-party platforms.

9. No Cancellation or Refund Policy; Transfers Only

All event ticket purchases are final. Cancellations are not permitted, and refunds will not be issued, including for no-shows, schedule conflicts, travel disruptions, illness, change of plans, or inability to attend.

If you are unable to attend, you may request to transfer your registration to another eligible attendee, subject to Destination AI approval and operational deadlines.

Transfers and Substitutions

Registrations may be transferred from one attendee to another attendee before the event, subject to Destination AI approval.

Transfer requests must be submitted in writing to:

Transfers requested within seventy-two (72) hours of the event cannot be guaranteed. Transfers between ticket types may not be permitted, including but not limited to speaker passes, sponsor passes, complimentary passes, discounted passes, student passes, or other restricted-access registrations.

Destination AI reserves the right to deny any transfer request that is incomplete, inaccurate, submitted too close to the event, inconsistent with the original ticket type, or otherwise not appropriate for the event.

Event Cancellation, Postponement, or Changes

Destination AI reserves the right to cancel, postpone, relocate, reschedule, modify, or convert any event, session, workshop, reception, or program to a virtual or hybrid format for any reason, including circumstances beyond our reasonable control.

If an event is postponed, rescheduled, relocated, or converted to a virtual or hybrid format, your registration may be transferred to the new date, location, or format, as determined by Destination AI.

Destination AI is not responsible for travel, lodging, transportation, meals, or other costs incurred by attendees, sponsors, exhibitors, speakers, or guests in connection with a canceled, postponed, relocated, rescheduled, or modified event.

10. Sponsorships, Exhibitors, and Paid Partnerships

Sponsorships, exhibitor opportunities, workshops, roundtables, hosted events, branded activations, and paid partnerships may be subject to separate written agreements, invoices, sponsorship terms, or order forms. If there is a conflict between these Terms and a signed written agreement between Destination AI and a sponsor, exhibitor, or partner, the signed written agreement will control for that specific sponsorship, exhibitor opportunity, or partnership.

Destination AI does not guarantee any specific number of attendees, leads, meetings, introductions, sales, business opportunities, press mentions, or commercial outcomes from any sponsorship, exhibitor opportunity, workshop, roundtable, or event participation unless expressly stated in a signed written agreement.

11. Event Programming and Speakers

Event speakers, sponsors, sessions, agendas, venues, timing, formats, and programming are subject to change at any time. Destination AI does not guarantee the attendance or participation of any particular speaker, sponsor, attendee, company, or organization.

Views expressed by speakers, sponsors, attendees, exhibitors, contributors, or other participants are their own and do not necessarily reflect the views of Destination AI.

12. Use of Likeness

By attending or participating in a Destination AI event, whether in person or virtually, you grant Destination AI and its affiliates, contractors, partners, sponsors, and service providers the right to photograph, film, record, livestream, capture, reproduce, publish, distribute, display, edit, and otherwise use your name, image, likeness, voice, company name, title, and participation in any media now known or later developed.

This use may include event promotion, recap materials, social media, website content, newsletters, press, sponsor materials, advertising, research, and other business or promotional purposes, without further approval from or payment to you.

If you have concerns about photography or recording at an event, please contact us before attending.

13. Code of Conduct

Destination AI is committed to providing a professional, respectful, and inclusive event environment. Attendees, speakers, sponsors, exhibitors, partners, and guests are expected to conduct themselves respectfully and professionally.

Destination AI may deny access to, remove, or ban any person from an event or Service if we determine, in our sole discretion, that the person has engaged in disruptive, unsafe, unlawful, harassing, discriminatory, threatening, fraudulent, or otherwise inappropriate conduct.

No refund will be required if a person is removed for violating these Terms, event policies, venue rules, or applicable law.

14. User Submissions and Content

You are responsible for any information, materials, comments, applications, survey responses, speaker materials, sponsor materials, company descriptions, logos, images, videos, or other content you submit to Destination AI.

By submitting content to Destination AI, you represent that you have the right to provide such content and that the content does not violate the rights of any third party.

You grant Destination AI a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, reproduce, publish, display, distribute, edit, adapt, and create derivative works from submitted content in connection with our Services, events, marketing, research, reporting, and business operations.

You retain ownership of your content, subject to the rights granted in these Terms or any separate written agreement.

15. Intellectual Property

All content and materials made available through the website or Services, including text, graphics, logos, designs, images, photographs, audio, video, software, data, reports, directories, event materials, and the overall look and feel of the website and events, are owned by or licensed to Destination AI, unless otherwise indicated.

16. Copyright Complaints

If you believe that content on our website or Services infringes your copyright, please contact us with the following information:

  • Your physical or electronic signature;
  • Identification of the copyrighted work you claim has been infringed;
  • Identification of the allegedly infringing material and where it appears;
  • Your name, address, telephone number, and email address;
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, agent, or law;
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

17. Prohibited Uses

You agree not to use the website or Services to:

  • Violate any applicable law, regulation, or third-party right;
  • Submit false, misleading, defamatory, offensive, discriminatory, harassing, or unlawful content;
  • Upload viruses, malware, or harmful code;
  • Attempt to gain unauthorized access to any system, account, platform, data, or network;
  • Interfere with the operation, security, or availability of the website or Services;
  • Scrape, harvest, mine, or collect data without authorization;
  • Use the Services for unauthorized advertising, spam, or solicitation;
  • Misrepresent your identity, affiliation, company, credentials, or registration status;
  • Resell, transfer, or misuse tickets, passes, sponsor benefits, or event access without authorization.

18. Disclaimers

The website, Services, events, content, materials, and third-party links are provided on an “as is” and “as available” basis. Destination AI makes no warranties, express or implied, regarding the website, Services, events, content, programming, sponsors, speakers, or results obtained from use of the Services.

Destination AI does not warrant that the Services will be uninterrupted, error-free, secure, accurate, complete, or free of viruses or other harmful components.

Destination AI does not provide legal, financial, tax, investment, technical, or professional advice. Any content, research, sessions, or materials are provided for general informational and educational purposes only.

19. Limitation of Liability

To the fullest extent permitted by law, Destination AI and its officers, directors, managers, members, employees, contractors, agents, affiliates, licensors, sponsors, partners, vendors, and service providers will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost revenues, lost business opportunities, lost data, business interruption, or reputational harm, arising out of or relating to your use of the website, Services, events, or content.

To the fullest extent permitted by law, Destination AI’s total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to Destination AI for the specific Service giving rise to the claim.

20. Indemnification

You agree to indemnify, defend, and hold harmless DAI Events LLC d/b/a Destination AI, together with its officers, directors, managers, members, employees, contractors, agents, affiliates, licensors, sponsors, partners, vendors, and service providers, from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • Your use of the website, Services, or events;
  • Your violation of these Terms;
  • Your submission of content, information, or materials;
  • Your violation of any law or third-party right;
  • Your conduct at or in connection with any Destination AI event.

Destination AI reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.

21. International Users

Destination AI is operated from the United States. If you access the website or Services from outside the United States, you are responsible for compliance with applicable local laws.

If you are located outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States or other jurisdictions where our service providers operate.

22. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, operate our business, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud or abuse, and maintain business records.

When we no longer have a legitimate business need to retain personal information, we will delete, anonymize, or securely store it in accordance with applicable law and our internal policies.

We may update or modify these Terms from time to time. If we make changes, we will update the “Last Updated” date above and post the revised Terms on our website.

Your continued use of the website, registration for an event, attendance at an event, or use of the Services after changes are posted means you accept the revised Terms.

24. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms, the website, Services, or events will be brought in the state or federal courts located in New York County, New York, unless otherwise required by applicable law or agreed in a separate written agreement.
